Stapletons Solicitors offers a well-established wills, probate, trusts and tax department which has served the local community in Palmers Green and further afield in North London and Hertfordshire over many years. We also specialise in the preparation and registration of Lasting Powers of Attorney and Court of Protection applications.
Wills
Your Will, as a final statement of what you wish to happen to your estate after you have died, is an extremely important document. If you die without a valid Will, your estate passes under the laws of intestacy; in most cases your estate would be split between a number of people, including your spouse, children, parents or siblings. If you are not married or in a civil partnership your partner may not be entitled to receive anything from your estate.
We advise all our clients to have a Will, if only to simplify the administration of your estate and ensure the right people inherit your assets. There are many other instances in which it is important to have a Will, such as:
If you run your own business;
If you own substantial business assets such as shares in a private company;
If you are a landlord;
If your assets are in excess of your inheritance tax allowance (which is currently £325,000);
If you are unmarried but live with a partner;
If you have children;
If you wish to provide for a disabled relative in your Will;
If you are concerned with ensuring your wealth stays in the family and is not used to pay for care fees;
If you have children from a previous relationship
The above list is not exhaustive; your Will is a simple and inexpensive way of making certain that your loved ones do not suffer unnecessary hardship or heartache after you have passed away.
Stapletons Solicitors Will-Writing services start from £99 plus VAT for a simple Will. You will receive professional advice from a solicitor on your circumstances and the content of your Will so as you can be certain that your wishes are effected and the people you wish to inherit your estate do so. We also offer to store your Will free of charge.
Probate
We aim to provide a reliable and caring service, especially when dealing with the estates of recently departed loved ones. We deal with a wide range of estates, from small estates where speed and cost-efficiency is key, to large estates of high net-worth individuals, where diligence and ensuring the value of the estate is maximised through effective tax planning are necessary.
Stapletons probate service can assist with all aspects of administering a person’s estate, from registering the death and arranging the funeral to finally winding up the estate and distributing the assets.
The position of Executor or Administrator can be onerous and in most cases should not be taken on lightly. We can advise anyone taking on such a role on the prudent steps they should take to ensure they properly discharge their duties and minimise the risk of incurring any personal liability.
Trusts
Our expertise in this area enables us to advise our clients on all forms of trust, whether they have been set up to provide for family members or for tax reasons. Setting up a trust can be complex and whatever your goals, it requires detailed and careful consideration of your circumstances and wishes.
Our aim is to help set up the appropriate trust structure for your situation in a cost-effective and prompt manner.
Powers of Attorney
There are many occasions where you may wish to give another person the authority to deal with your affairs on your behalf, for example if you are going abroad for an extended period of time.
It is also possible to create a Lasting Power of Attorney (LPA). This allows you to choose someone to make decisions for you in the event you lack the mental capacity to do so yourself. An LPA can relate to your property and affairs or personal welfare and must be registered with the Office of the Public Guardian before it can be used.
The process involved in setting up an LPA can be quite complex and full of pitfalls for the unwary. We aim to guide you through the process and provide you with expert legal advice to ensure you receive peace of mind by knowing that your wishes will be respected if the worst were to happen.

Other Services
In addition to those areas listed above the firm’s private client department can advise on change of name deeds, advice on local authority care fees and Court of Protection applications.
